By engaging in live auction services hosted by Waste Junction and participating in live auction events, you agree to adhere to the terms and conditions outlined in this Agreement. This agreement is applicable to your use of Waste Junction's live auction services on various platforms, such as WasteJunction.com and affiliated websites.

Before becoming a Waste Junction member, it is crucial to carefully read and accept all terms and conditions present in this Agreement and our Privacy Policy, including those accessible through hyperlinks and the Auction Terminology listing. Some Waste Junction-branded websites may have separate user agreements and privacy policies that you should review as well.

Please note that Waste Junction reserves the right to amend this Agreement at any time by posting revised terms on the website. Such changes become effective prospectively upon posting. We encourage you to periodically review our terms of use for updates.

Live Auction Agreement

Eligibility: Each Waste Junction conducting a live auction may have specific eligibility requirements. Approval to participate in one auction does not guarantee approval for others. Waste Junction holds the discretion to refuse eligibility for any live auction.

Fees: Waste Junction may impose buyer's premiums, shipping, handling, and other fees, subject to change based on the auction and item. The fees are set by Waste Junction.

Waste Junction is Only a Venue: a. We facilitate communication between you and Waste Junction but do not conduct live auctions. b. We lack control over item quality, safety, legality, or the ability of Waste Junctions to sell. We don't guarantee transaction completion. c. Compliance with laws is your responsibility. Waste Junction's role is to provide a conduit for auction participation.

Waste Junctions: The Waste Junction lists available items for bidding, with auction details subject to change. We do not control the information provided by Waste Junctions and do not guarantee their compliance with laws.

Bidding, Buying, and Conditions of Sale: Each auction's terms, including bid acceptance, rules, and conditions, may vary. You agree to be bound by the bidding terms, conditions, and this Agreement.

Video and Audio: Live auction event audio or video elements are for entertainment purposes only.

Use of Images: Waste Junction may use images of items on its website and in promotional materials.

Using Waste Junction: While using Waste Junction, you agree not to violate laws, manipulate prices, post false content, distribute spam, or engage in prohibited conduct. Violation may lead to access prohibition.

Abusing Waste Junction: We may take measures to address misuse, including limiting, suspending, or terminating services.

Access and Interference: Automated access without permission is prohibited. Users shall not interfere with site functionality.

Privacy: User-provided information is governed by our Privacy Policy. Users' information provided to Waste Junction is subject to its privacy policy.

Intellectual Property/Restrictions on Use: Users may not misuse site design or content. All trademarks and materials are protected by applicable laws.

Indemnity: Users will indemnify Waste Junction from third-party claims arising from breaches or violations.

No Agency: This Agreement does not create agency relationships.

No Warranty: Waste Junction's services are provided "as is." We do not guarantee uninterrupted service or the performance of Waste Junctions. Users assume the risk.

Liability Limit: We and our suppliers are not liable for special, indirect, or consequential damages. Our liability is limited to the greater of fees paid or $100. Some states' laws may vary.

Notices: Notices are sent via certified mail or email. Notice given by email is deemed given the business day following transmission.

Force Majeure: Parties are not liable for failure or delay due to Force Majeure events.

Arbitration: Disputes may be settled through mediation and arbitration, with the prevailing party entitled to costs and attorneys' fees.

General: The Agreement constitutes the entire understanding, governed by the laws of the State of India. In case of invalidity, the remainder of the Agreement remains in force.

Future Terms: Waste Junction may update these terms, and your continued use implies acceptance of such changes. Discontinuation is advised if future changes are unacceptable.
